Aggressively Defending Alleged Sex Crimes and Child Abuse Allegations

As a consultant working on child abuse & sexual assault cases all over the country there seems to be two trends developing that are worrisome. I maintain the majority of lawyers know just enough about sex crimes and child abuse to be dangerous – not necessarily effective. There is a pattern I most often see when I first become involved in a case where the defense is no defense. Make no mistake none of these cases are easy and the defendant has the realistic burden of proof. It is our burden to explain what is happening and why someone is sitting at the defense table innocent and/or over charged. Further, there appears to be an increasingly obvious lack of pretrial appeal groundwork being formulated in the sad event of a false conviction.  I see these problems regardless of allegations of sexual assault of an adult or child abuse allegations. Don’t be afraid to ask a lawyer what their strategy is and if they don’t have one, maybe you/they need to hire a consultant.  It is surely much easier to stay out of prison then to get out through appeals.

    have a stepson that has been arrested 4 aggravated child abuse the charges are false and untrue. I have hired a lawyer to defend him the first things I want to do have my step-son take a polygraph test. my lawyer sent out the 25-year veteran of the FBI and I ended up having to pay him $1,200 to administer a polygraph test stand back negative. the results of the examination were so clean the examiner ran the test and got the same results for a second time. we have hired medical experts as well and are medical experts are telling us that the babies Longwood collapse by the emergency medical technicians she alsohad a stroke at the hospital under their care she had the stroke because they did not follow proper protocol when she was brought in by the emergency medical vehicle instead of taking her directly upstairs to do a CT scan they decided to do chest x-rays bone scan and blood tests CT scans were not done for several hours later by that time she had stroke she has been taken to a second Hospital child protective team was brought in and the lead of that team diagnose this baby shaken baby syndrome. I would very much like to consult with you about the details of this case and get an opinion from you on further course of action. I hope you can help

  • I readily agree with your statement. After 3 trials, and 8 attorneys i see a vast difference in level of service as well as capability – but they are supposed to do an effective job of defense, whether or not their client is guilty. In the end? They all get to go home at night, and they always get paid.

  • Indeed, your comments ring painfully true Kim. Persons falsely accused must understand the essential need for defense investigation. Thus, when interviewing attorneys, learning the attorney’s philosophy on pre-trial investigation and their experience in collaborating with a skilled and trusted defense investigator is one of the first areas they should explore. The average citizen has no idea who easily they can fall through the cracks of justice by hiring an attorney who does not promote and provide diligent investigation of the case.
